오상방위

오상방위(誤想防衛)란 정당방위의 객관적 전제사실이 존재하지 않음에도 불구하고 행위자는 그것이 존재하는 것으로 오신하고 방위행위로 나아간 경우이다. 오상방위는 위법성조각사유의 전제사실에 대한 착오(허용구성요건 허용상황의 착오)에 해당되는 문제이다. 이 경우 다수설인 법효과제한적 책임설에 의하면 위법성조각사유의 전제사실의 착오에 대해 구성요건적 고의는 조각되지 않지만 형법적효과만은 고의책임이 아닌 과실책임을 인정한다.
